Terms of Service

These terms explain how Provision may be used for pilot access, beta features, subscriptions, and restaurant operational intelligence workflows.

Acceptance of terms

These Terms of Service govern access to and use of Provision. By creating an account, joining a pilot, using a Provision workflow, or allowing team members to use Provision on your behalf, you agree to these terms.

If you use Provision for a restaurant, restaurant group, or other organization, you represent that you are authorized to accept these terms for that organization.

Pilot and beta availability

Provision may offer pilot, beta, early-access, or preview features. These features may change, be incomplete, contain errors, have limited availability, or be discontinued as the product develops.

Pilot and beta access is provided for evaluation and controlled rollout. Provision may add, remove, or revise features during a pilot without promising that every feature will become generally available.

Account responsibility

You are responsible for maintaining accurate account information, managing authorized users, setting appropriate roles and permissions, and keeping login credentials secure.

You are responsible for activity under your account and for making sure team members use Provision in a lawful, authorized, and reasonable way.

Restaurant data and user content

You retain responsibility for data, files, recipes, vendor information, POS data, inventory counts, pricing data, messages, and other content that you or your connected systems provide to Provision.

You grant Provision permission to process that information as needed to provide, secure, troubleshoot, support, and improve the service. You should only upload or connect data that you have the right to use.

Provision handles information according to its Privacy Policy.

Acceptable use

You may not use Provision to violate law, infringe rights, upload malicious code, interfere with the service, attempt unauthorized access, scrape or reverse engineer the service, abuse public forms or invite links, or use Provision for deceptive, harmful, or unlawful activity.

You may not use Provision to submit data that you do not have permission to use or to send unauthorized messages to employees, vendors, customers, or other parties.

Third-party services and integrations

Provision may connect with POS systems, vendors, accounting tools, SMS providers, payment processors, EDI providers, storage providers, analytics tools, and other third-party services.

Those integrations may depend on third-party availability, permissions, API limits, account configuration, provider approval, and data quality. Provision is not responsible for third-party service outages, policy changes, data errors, permission failures, or provider delays.

Operational intelligence and final decisions

Provision provides operational intelligence, recommendations, alerts, draft workflows, and review queues to help restaurants understand what needs attention.

Provision does not make final business decisions for you. You remain responsible for reviewing and approving vendor orders, pricing decisions, menu changes, inventory adjustments, payroll or accounting decisions, legal compliance, tax treatment, employee practices, and other operational decisions.

Provision does not guarantee uptime, savings, margin growth, error-free automation, perfect data accuracy, or specific financial results.

No professional advice

Provision is not a law firm, accounting firm, tax advisor, financial advisor, food safety consultant, HR advisor, or compliance advisor.

Information from Provision is provided for operational review and decision support. You should consult qualified professionals for legal, tax, accounting, employment, regulatory, or compliance questions.

Subscriptions, billing, and cancellation

Some Provision features may be offered through paid subscriptions, usage-based fees, pilot pricing, or other commercial arrangements. Pricing, billing cadence, included features, and any pilot terms may be provided in an order form, checkout flow, written agreement, or other customer communication.

Unless a separate written agreement says otherwise, you are responsible for approved charges, applicable taxes, and maintaining accurate billing information. Cancellation terms, renewal terms, and refund eligibility may depend on the plan or agreement that applies to your account.

Transactional SMS

Provision may send transactional operational SMS messages when a restaurant operator provides a mobile number or invites a team member into workflows such as inventory counts, operational alerts, receiving/count coordination, and team workflows.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out, START to opt back in, or HELP for help. Provision does not send marketing or promotional SMS through this messaging program. SMS delivery is carrier-dependent and is not guaranteed.

Disclaimers

Provision is provided on an "as is" and "as available" basis to the fullest extent allowed by law. Provision disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free operation.

Provision may rely on third-party data, user-entered data, integration data, vendor files, POS exports, invoice information, and other inputs that may be incomplete, delayed, inaccurate, unavailable, or formatted unexpectedly.

Limitation of liability

To the fullest extent allowed by law, Provision and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost savings, lost data, business interruption, or procurement of substitute services.

To the fullest extent allowed by law, Provision's total liability for claims relating to the service will not exceed the amount paid by the customer to Provision for the service during the three months before the event giving rise to the claim, or one hundred dollars if no amounts were paid.

Termination

You may stop using Provision at any time. Provision may suspend or terminate access if you violate these terms, create security or legal risk, fail to pay amounts owed, misuse the service, or if continued access is no longer commercially or operationally reasonable.

After termination, Provision may retain information as needed for legal, security, backup, billing, dispute, and legitimate business purposes, consistent with its Privacy Policy.

Changes to terms

Provision may update these terms from time to time. When changes are material, Provision will make reasonable efforts to provide notice through the website, product, email, or other appropriate channel.

Continued use of Provision after updated terms are posted or communicated means you accept the updated terms.
